CONTROL POWERS OF THE NATIONAL COMMISSION, WHICH CARRIES OUT STATE REGULATION IN THE SPHERES OF ENERGY AND COMMUNAL SERVICES

Abstract

The article analyzes the controlling activities of the National Energy and Utilities Regulatory Commission of Ukraine. It is established that the National Energy and Utilities Regulatory Commission is legally endowed with a special status which is conditioned by its powers and determined by law and consists, in particular, in the peculiarities of organization and procedure of its activities, in the special procedure for appointment of its members and termination of their powers, in special procedural principles of activity and guarantees of independence in decision-making within the powers defined by law, and in setting the terms of remuneration of its members and their employment. The author describes the control activities of the National Energy and Utilities Regulatory Commission of Ukraine through its internal and external activities. The author distinguishes two types of control – internal and external. Internal control concerns control powers to resolve issues within this public administration entity. Internal control powers are mostly vested in the head of the National Commission. It is established that external control is exercised over other entities authorized to carry out state regulation in the field of energy and utilities. As part of external control, the National Commission exercises state control over compliance by business entities operating in the energy and utilities sectors and entities belonging to a special group of consumers within the meaning of the Law of Ukraine "On the Electricity Market", legislation in the relevant areas and license conditions by conducting scheduled and unscheduled on-site and off-site inspections in accordance with the control procedures approved by it.
